As a resident of the City of Newton Massachusetts I am requesting that the recently implemented City of Newton Tree Ordinance Chapter 21, Art III Trees be repealed and that my private property rights be respected. While I support protecting and preserving the valuable tree canopy of our city, the specific components of the ordinance outlined below are unacceptable.
The provision which allows the Tree Save Area of my neighbor’s trees to impact my ability to use my Private Property.
The provisions of this ordinance requiring myself or a professional to potentially trespass on my neighbor’s property to measure, survey, classify or determine the health of their trees.
Requiring Tree Warden Approval for any exterior work on my private property that falls within a Tree Save Area.
The provision that I, as a private property owner, would be required under any circumstance to replace the caliper inches or pay for those inches for any tree I elect to cut on my property.
Language requiring that I, as a private home owner, retain the services of a certified arborist prior to exterior work on my private property.
The requirement that I notify my neighbors prior to doing any tree related work on my private property.
